1. Website Use and Intellectual Property

1.3 User Obligations: You agree to use the website only for lawful purposes. You must not misuse the site by introducing viruses, trojans, or other malicious material, or attempt to gain unauthorized access to our systems.

2. Product Information and Service Description

2.1 Product Range: Michaels Shop specializes in premium, hand-curated artificial botanicals. Our collections include Artificial Trees, Floral Arrangements, Greenery Garlands & Wreaths, Potted Plants, Moss, and complementary stems, bushes, and picks.

2.2 Product Characteristics: Our products are hand-assembled and curated. Slight variations in shade, leaf placement, or arrangement are inherent to their artisanal quality and are not considered defects. Every piece undergoes stringent quality checks before shipment.

2.3 Custom & Final Sale Items: Due to their bespoke nature, the following are considered final sale and are not eligible for return or exchange:

• Custom Floral Arrangements (including Tabletop Floral Arrangements).
• Made-to-Order Greenery Garlands & Wreaths.
• Any Bundles & Bouquets that have been opened or separated from their original packaging.

3. Orders and Payment Terms

3.1 Order Process: Placing an order constitutes an offer to purchase. We reserve the right to refuse or cancel any order for any reason, including limitations on product availability, errors in product or pricing information, or suspected fraud.

3.2 Pricing: All prices are listed in US Dollars. We reserve the right to adjust prices at any time, but changes will not affect confirmed orders.

3.3 Payment Methods: We accept payments via Visa, MasterCard, JCB, and PayPal. Payment is processed securely at the time of order confirmation.

3.4 Order Confirmation & Processing: You will receive an order confirmation email. All orders are processed within 1-2 business days after payment confirmation.

4. Shipping Policy

4.1 Service Area: We ship globally, excluding Asia and select remote regions. It is the customer’s responsibility to ensure their shipping address is within our service area and is correct.

4.2 Shipping Methods & Costs:

• Standard Shipping: Via DHL or FedEx. A flat rate of $12.95. Estimated delivery: 10-15 business days after dispatch.
• Free Shipping: Via EMS for all orders over $50. Estimated delivery: 15-25 business days after dispatch.

Delivery times are estimates and may vary due to customs or carrier delays.

4.3 Customer Responsibility for Import Duties: All applicable customs duties, import taxes, and fees are the sole responsibility of the customer. Michaels Shop has no control over these charges and cannot predict their amount.

5. Returns, Exchanges, and Refunds

5.1 Return Window & Condition: Most non-final sale items may be returned within 15 days of the delivery date. Items must be in original, unused, and resalable condition, with all tags, packaging, and accessories intact.

5.2 Return Process:

1. Contact Customer Care at [email protected] within the 15-day window to request a Return Merchandise Authorization (RMA).
2. Do not ship items back without an RMA.
3. Securely pack the item(s) with a copy of your order confirmation and the RMA number clearly marked.
4. Ship to the address provided using a trackable and insured service. The customer is responsible for return shipping costs, unless the return is due to our error.

5.3 Refunds: Upon receipt and inspection of the returned item, we will process your refund to the original payment method within 5-7 business days. The refund may take an additional 3-10 business days to appear in your account.

5.4 Damaged or Incorrect Items: If your item (e.g., a Potted Plant or Greenery Mat) arrives damaged or is incorrect, you must contact us at [email protected] within 48 hours of delivery with photos. We will arrange a prepaid return label or replacement at no cost to you.

6. Limitation of Liability

6.1 General Limitation: To the fullest extent permitted by law, Michaels Shop shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising from your use of the site or any products purchased, even if we have been advised of the possibility of such damages.

6.2 Maximum Liability: Our total liability for any claim arising from your order shall not exceed the total amount you paid for the specific product(s) giving rise to the claim.

6.3 Product Use: Our artificial botanicals are designed for decorative indoor use. We are not liable for any damage or injury resulting from improper use, modification, or placement of our products.

7. Governing Law and Contact

7.1 Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.
